General terms and conditions of sale and delivery for customer orders

The following general terms and conditions of sale and delivery apply to business transactions between EIZO AG and end-user store customers of EIZO AG. Changes to these conditions by the customer require the written approval of EIZO AG.

1. Prices

1.1.    EIZO AG charges the customer the price displayed online for the product including VAT and the advanced recycling fee (vRG). If the customer decides in the End User Shop to place the order with an EIZO sales partner, the GTC of the respective provider always apply.
1.2.    Freight costs and packaging are included in the prices.
1.3.    Express deliveries will be charged additionally.
1.4.    When purchasing from the EIZO End User Shop, you will not be charged shipping costs for orders of monitors under standard shipping. If only items are ordered that are not monitor items, shipping charges of CHF 12 will be applied.  

2. Orders

2.1.    In principle, the order is valid if it is confirmed by EIZO AG in writing by e-mail.
2.2.   The information in our sales documents (drawings, illustrations, dimensions, weights and other performances) are only to be understood as approximate values and do not represent any assurance of properties unless they are expressly designated in writing as binding.
 

3. Delivery

3.1.    EIZO AG delivers exclusively to Switzerland and Liechtenstein.
3.2.   Delivery is made from the warehouse EIZO AG or from the European central warehouse of EIZO. The availability and the deliverability cannot be guaranteed. The indicated delivery dates are to be seen as approximate values. EIZO AG assumes no liability for damages resulting from late deliveries.
 

4. Acceptance of the delivery

4.1.    Complaints about a delivery must be made in writing within 3 working days after receipt of the goods. Otherwise, the delivery shall be deemed accepted.
4.2    Deliveries are insured against damage in transit. Consignments with damage must be reported immediately to the transport company concerned for the purpose of drawing up the damage report.
 

5. Returns

5.1.    Returns (no later than 7 days after delivery) are only permitted with prior agreement and an RMA number issued by EIZO AG. After expiration of the 7 days in principle no more products are taken back.
5.2    If the return shipment is not complete or the original packaging shows damages, EIZO AG reserves the right to return the shipment or to charge a reasonable amount for the repair.
 

6. Warranty and Repairs

6.1.    The warranty period granted by the manufacturer applies to all products. EIZO AG does not assume any warranty obligation exceeding the respective manufacturer's warranty.
 

7. Payment

7.1.    EIZO AG offers the following payment options:
- Payment with credit cards from VISA and MasterCard
- Payment with PostFinance E-Finance
- Payment via TWINT
7.2    The goods remain the property of EIZO AG until full payment has been received.
 

8. Limitation of Liability

8.1.    Claims for damages arising from impossibility of performance, from breach of contract, from culpa in contrahendo and from tort, are excluded against us, unless there is intentional or grossly negligent action. For consequential damages from the use of the products, any liability is rejected.
 

9. Copyrights / Software Warranty

9.1.    Insofar as software is included in the scope of delivery, it is provided to the buyer solely for one-time resale or for his own use, i.e. he may neither copy it nor provide it to others for use. Software is excluded from all warranty provisions on forms. The provisions of the manufacturer's license agreement shall apply exclusively.
 

10. Jurisdiction

10.1 Place of performance for delivery and payment is Wädenswil, place of jurisdiction is Horgen. However, EIZO AG is entitled to sue the Purchaser at any other justified place of jurisdiction.
